Qantas A380 Promotion
Terms and Conditions

1. Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion or use of a prize is deemed acceptance of these terms and conditions.

2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 203 Coward Street, Mascot, NSW, Australia (tel 02 9691 3636) (Promoter).

3. The promotion commences at 00.01 (AEST) on 21 September 2008 and closes at 23.59 (AEDT) on 30 November 2008 (Promotion Period).

4. Entry is open only to Australian residents who are able to use the prize as stated in paragraph 12 (Eligible Entrants), excluding:

(a) officers, management, employees (and their immediate families) of the Promoter and its related bodies corporate; and

(b) the registered travel companions of employees of the Promoter and its related bodies corporate.

5. There are two methods of entering the promotion. Eligible Entrants who are members of the Qantas Frequent Flyer program (Eligible QFF Entrants) may enter under paragraph 6(a). All other Eligible Entrants must enter under paragraph 6(b). Among the other requirements identified in paragraph 6, each entry method requires that the relevant Eligible Entrant is listed as a passenger on the booking confirmation for an Eligible Flight that is booked and paid for during the Promotion Period. For the purposes of these terms and conditions, an 'Eligible Flight' is a commercial passenger flight or a Qantas Frequent Flyer Award flight, to be operated by Qantas Airways Limited or under the QantasLink brand, for which the booking confirmation identifies a 'QF' flight number.

6. Eligible Entrants can enter the promotion as follows:

(a) Eligible QFF Entrants will receive:

(i) one entry in the draw for the prizes identified in paragraph 12(a) (Major Prize Draw); and

(ii) one entry in the draw for the prizes identified in paragraph 12(b) (Frequent Flyer Prize Draw),

for each Eligible Flight that is booked and paid for during the Promotion Period and for which the booking confirmation identifies them as a passenger, so long as:

(iii) the booking is not cancelled during the Promotion Period;

(iv) by the end of the Promotion Period, they have their Frequent Flyer membership number recorded against that the Promoter's record of the booking (whether by providing that number at the time of booking or otherwise); and

(v) during the Promotional Period, they register their name, Qantas Frequent Flyer membership number, valid email address and any other required details at qantas.com/A380promotion.

(b) Eligible Entrants who do not enter under paragraph (a) will receive one entry into the Major Prize Draw for each Eligible Flight that is booked and paid for during the Promotion Period and for which the booking confirmation identifies them as a passenger, so long as:

(i) the booking is not cancelled during the Promotion Period; and

(ii) during the Promotion Period, they register the details of that Eligible Flight (including the relevant booking reference), along with their name, daytime telephone contact number, valid email address and any other required details at qantas.com/A380promotion.

7. The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.

8. The prize draws will take place at midday (AEDT) on 10 December 2008 (Draw Date) at the offices of Mike Da Silva and Associates (Aust) Pty Ltd (ABN 50 003 894 022) (MDSA) at 15 Grosvenor Street, Neutral Bay NSW 2089, and will be conducted and scrutinised by MDSA.

9. The result of each draw is final and no correspondence will be entered into. The winners will be notified by mail within two days of the Draw Date and their names will be published in The Australian newspaper on 17 December 2008.

10. Subject to applicable law:

(a) an Eligible Entrant residing in a jurisdiction other than South Australia may only win a maximum of one prize; and

(b) if an Eligible Entrant residing in a jurisdiction other than South Australia is drawn more than once for a prize in this promotion (whether in the same draw or a subsequent draw), the second and any subsequent drawings of that entrant will be disregarded.

11. The Promoter reserves the right to request that winners provide proof of identification, age and Australian residency prior to receiving their prize. Proof of identification, age, and residency considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.

12. There will be 418 prizes and two prize draws. The Major Prize Draw will award 38 prizes. The Frequent Flyer Prize Draw will award 380 prizes.

(a) Major Prize Draw

The first 38 valid entries drawn from all entries in the Major Prize Draw will be awarded the following prize (the Major Prize):

(i) Two Qantas adult return Economy class tickets, departing from the winner's nearest Qantas serviced port in Australia to the winner's choice of either:

A. London (flying in at least one direction between Sydney and London on a flight scheduled to be operated by a Qantas Airbus A380 aircraft); or

B. Los Angeles (flying in at least one direction between Sydney and Los Angeles or Melbourne and Los Angeles on a flight scheduled to be operated by a Qantas Airbus A380 aircraft)

(ii) A$3,000 credit with Qantas Holidays (QH Credit) for land arrangements available from Qantas Holidays (such as accommodation, transfers, car hire, theme park or theatre tickets). This QH Credit is only redeemable for land arrangements in conjunction with the travel identified in paragraph (i), and cannot be used towards Qantas, Jetstar or any other airfares, Qantas Frequent Flyer redemption bookings or Qantas fees.

(iii) In addition, if, as a result of flight schedules and/or availability:

A. a winner's connecting domestic and international prize flights occur on different days; and

B. the winner and their travel companion must as a consequence stay overnight in the Australian city at which those flights connect,

the Promoter will award to the winner twin share accommodation in that Australian city for two persons for the night of that overnight stay.

Based on its recommended retail value and exchange rates at the time of printing, the maximum retail value of each Major Prize is A$11,656.00. The value of the Major Prize will also vary depending on each winner's Point of Origin in Australia, their chosen destination, and the prize flights they take.

(b) Frequent Flyer Prize Draw

The first 380 valid entries drawn from all entries in the Frequent Flyer Prize Draw will each win a Qantas A380 die cast model aircraft with stand and commemorative plaque (Frequent Flyer Prize). Based on its recommended retail value, the maximum value of each Frequent Flyer Prize is A$65.95.

13. The maximum total prize pool value is A$467,989.00, based on the recommended retail value of the elements of each prize and exchange rates at the time of printing. The Promoter accepts no responsibility for any variation of the value of the prizes.

14. Entrants acknowledge and agree that flights scheduled to be operated by Airbus A380 aircraft may be operated by alternative aircraft in the event that a last minute aircraft change is necessary.

15. Each prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. Prizes are not transferable to another person (unless agreed by the Promoter) or exchangeable for other goods and services and cannot be redeemed for cash.

16. In the event that a winner is under the age of 18 years, the prize will be awarded to the winner's parent(s) or legal guardian.

17. The Major Prize does not include:

(a) spending money, meals, stopovers other than stated, hotel car parking, other hotel incidentals, taxes not included in the price of the tickets, visas, passports, travel or other insurance, gratuities, merchandise or any other costs of a related, ancillary, personal or incidental nature not stated; or

(b) accommodation, airport transfers, other ground transportation, or other land arrangements other than that for which QH Credit is redeemed.

(c) Without limiting the foregoing, entry into any country, satisfying any customs or related requirements, compliance with any health or other government requirements, any other travel documentation and any extras of a personal nature (including without limitation tips, telephone, and laundry charges) are the responsibility of each Major Prize winner and their nominated travel companion. Major Prize travel is subject to Qantas' General Conditions of Carriage. Tickets will not be exchanged for another destination.

18. Major Prize travel is subject to availability at the time of booking. Major Prize winners and their nominated travel companions cannot upgrade any part of the prize using cash or Qantas Frequent Flyer points and will not accrue Qantas Frequent Flyer points on any part of the prize. Each Major Prize winner must travel together with their nominated travel companion on the same flights on all sectors of prize travel.

19. All prize travel (including land arrangements for which QH Credit is redeemed) must commence and be completed between either:

(a) 1 February 2009 and 16 June 2009; or

(b) 18 July 2009 and 9 December 2009,

and will not be extended under any circumstances. If a winner cannot travel within these periods, the prize will be forfeited. If for any reason a winner does not take an element of the prize during the stated periods, and on the conditions stipulated by the Promoter (and those of any prize supplier), then that element of the prize will be forfeited. Any residual value of the QH Credit not utilised within these periods will also be forfeited.

20. If a prize or any element of a prize is forfeited under these terms and conditions or otherwise, cash will not be awarded in lieu of that prize or prize element.

21. Bookings will be made by the Promoter. QH Credit must be redeemed through the Qantas Travel shop or phone number advised by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade. Prize travel may not be changed for a destination other than London or Los Angeles under any circumstances.

22. The Promoter, its related bodies corporate, and their respective officers, employees, contractors and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

23. The Promoter reserves the right to refuse to allow a Major Prize winner and/or that winner's nominated travel companion to take part in any or all aspects of the Major Prize, if the Promoter determines, in its absolute discretion, that the person is not in the mental or physical condition necessary to be able to safely participate in the Major Prize. It is a condition of accepting the Major Prize that the winner (and their nominated travel companion) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

24. If for any reason the promotion is not capable of running as planned (including but not limited to as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.

25. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming the prize. For any prize that remains unclaimed on 27 March 2009, MDSA will conduct a second chance draw on that date at the same time and place as the original draws (subject to any directions given under applicable law). The winner(s) of any second chance draw will be notified by mail within two days and their name(s) will be published in The Australian newspaper on 3 April 2009.

26. Entry details remain the property of the Promoter. The name and photograph of winners may be used for promotional purposes by the Promoter, except where a winner otherwise notifies the Promoter at the time of accepting their prize. Entrants consent to the Promoter using their personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes. Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at qantas.com/privacy.
