Qantas Socceroos October 2009 SMS Promotion
1. Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.
2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 203 Coward Street, Mascot, NSW, Australia 2020 (tel 9691 3636) ('Promoter').
3. The promotion will be run in relation to two (2) Qantas Socceroos games in October 2009. In relation to the first game to be held at the Sydney Football Stadium on 10 October 2009 ('Sydney Game') the promotion will commence at 17.30 (AEST) on 10 October 2009 and will close at 21.30 (AEST) on 12 October 2009 ('Promotion Period 1'). In relation to the second game to be held at Etihad Stadium on 14 October 2009 ('Melbourne Game') the promotion will commence at 17.30 (AEST) on 14 October and will close at 21.30 on 15 October 2009 ('Promotion Period 2').
4. Subject to clause 5, entry into the Major Prize draw is open only to Australian residents over the age of 18 who are able to use the prize as stated in paragraph 11 (Eligible Entrants). The Promoter reserves the right to request that the winner provide proof of identification, age and Australian residency prior to receiving the prize. Proof of identification, age, and residency considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.
5. Directors, management, employees (and their immediate families) of the Promoter and their respective related bodies corporate, and the registered travel companions of employees of the Promoter and its related bodies corporate, are not eligible to enter this promotion.
6. To enter and be eligible to win the Major Prize, Eligible Entrants must, during the Promotion Period:
(a) text "Go Qantas Socceroos" to 1979 9799
(b) along with their full name
7. Each Eligible Entrant is permitted one entry into the promotion under paragraph 6.
8. The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
9. The prize draw for the Sydney Game will take place at 11am 13/10/09 ('Sydney Draw Date') at the Hyperfactory Level 2,439 - 441 Kent Street, Sydney, NSW 2000. The prize draw for the Melbourne Game will take place at 11am 16/10/09 ('Melbourne Draw Date') at the Hyperfactory Level 2,439 - 441 Kent Street, Sydney,NSW 2000
10. The result of the draw is final and no correspondence will be entered into. The winners will be notified by phone within 2 days of the respective Sydney Draw Date and Melbourne Draw Date and their names will be published in The Australian newspaper on 19 October 2009.
11. There will be one Major Prize for each promotion period. Subject to paragraph 18, the first valid entry drawn from both promotional groups will be awarded the following prize to be fulfilled in May 2010- date to be confirmed ('Date TBC') as soon as the farewell game date is released by the Football Federation of Australia
- two Qantas adult Economy tickets, departing from the winner's nearest Qantas serviced port in Australia ('Point of Origin') for arrival in Melbourne on Date TBC
- 1 nights accommodation (twin share) in Melbourne on the night of the game on Date TBC
- 2 Category A tickets to the Qantas Socceroos farewell match on Date TBC
- two Qantas adult Economy tickets departing from Melbourne Date TBC for arrival at the winner's 'Point of Origin'.
12. The maximum total prize value is up to A$1,400 and is based on the recommended retail value of the elements of the prize at the time of printing. The value of the prize will also vary depending on the winner's Point of Origin in Australia. The Promoter accepts no responsibility for any variation of the value of the prize.
13. The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize is not transferable to another person (unless agreed by the Promoter) or exchangeable for other goods and services and cannot be redeemed for cash. Each element of the prize may only be used on the date (and, if applicable, at the time) stated for that element of the prize in paragraph 11. Any element of the prize that is unused will be forfeited.
15. The prize does not include meals, stopovers other than stated, hotel car parking, other hotel incidentals, airport transfers or other ground transportation, taxes not included in the price of the ticket, visas, passports, travel or other insurance, gratuities, merchandise or any other costs of a related, ancillary, personal or incidental nature not stated. Compliance with any health or other government requirements, other travel documentation and any extras of a personal nature (including without limitation tips, telephone, and laundry charges) are the responsibility of the winner and their nominated travel companions. Prize travel is subject to Qantas' General Conditions of Carriage. Tickets will not be exchanged for another destination.
16. The winner and their nominated travel companion cannot upgrade any prize travel or prize accommodation using cash or Qantas Frequent Flyer points and will not accrue Qantas Frequent Flyer points on any prize flights or on any prize accommodation. The winner and their nominated travel companions must travel together on the same flights on all sectors of prize travel.
17. Prize travel must be undertaken on the dates stated in clause 11 and on the flights nominated by the Promoter. Prize travel may not be changed under any circumstances. If the winner cannot travel in accordance with clause 11 and on the flights nominated by the Promoter, the prize will be forfeited. If for any reason the winner does not take an element of the prize during the stated period, and on the conditions stipulated by the Promoter (and those of any prize supplier), then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize. Bookings will be made by the Promoter. Flight schedules and accommodation arrangements are subject to change without notice. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination.
18. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a prize. Subject to paragraph 19 (and any applicable law):
(a) the prize must be claimed by 5pm (AEST) on 20 October 2009;
(b) if the prize remains unclaimed at that time, it will be forfeited; and
(c) if the prize remains unclaimed at that time, or is otherwise forfeited, the Promoter will have The Hyperfactory conduct an unclaimed prize draw at that time, at the same place as the original draw, and the first valid entry drawn will be awarded the prize.
Any winner drawn under this paragraph 18 (c):
(i) will be notified in writing within 2 days and will have their details published in the public notices section of The Australian on 22 October 2009; and
(ii) must claim the prize by 5pm (AEST) on 23 October 2009 (and if not, will forfeit the prize).
19. Where the winner is a resident of any jurisdiction in which the law requires a longer period of time (than provided in clause 18) for the winner to claim the prize before any redraw is conducted, the prize will be forfeited if it is not claimed by 23 October 2009.
21. The Promoter, its related bodies corporate, and their respective officers, employees, contractors and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
22. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner (and their nominated travel companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
23. If for any reason the promotion is not capable of running as planned (including but not limited to as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.
24. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting their prize. Entrants consent to the Promoter using their personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes. Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at available at qantas.com/privacy.
